1 Sicpama

1.1 Who we are
We are Sicpama(singapore) Pte. Ltd. (“we”, “us” or “our”), but usually we just use the name Sicpama. These Terms form the contract between you and the following Sicpama entities: Tables & Sales for Restaurants | Sicpama

1.2 What we do
Through our Platform, Sicpama helps you to order menu at the table without pos system. When you scan the QR code via mobile phone or tablet, it leads to Sicpama´s mobile web service. In Sicpama´s web service, you can see the menu and order by pressing “place an order”. We also help you order together and split the bill with your group.

2 Use of the Platform and Sicpama Account

2.1 You will need to register for a Sicpama account for you to order and pay with Sicpama Platform. When you register for a Sicpama account for you to use the Platform, we will ask you to provide your personal information including a user id(valid email address or mobile phone number), nickname and a unique password. To purchase an Order, depending on which payment method you opt for, you may need to provide us with your credit card details. Your unique password and user id should not be shared with anyone and you agree to keep it secret at all times. You are solely responsible for keeping your password safe. Save for cases of fraud or abuse which are not your fault, you accept that all Orders placed under your Sicpama account are your sole responsibility. If you recognize that your ID and password are stolen or being used by a third party, you should immediately notify the company and comply with the company's measures, if any. You are responsible for any disadvantages arising from not following the rules above.

2.2 Sicpama shall not be liable for Orders that encounter delivery issues due to incomplete, incorrect or missing information provided by you. You are obliged to provide information that is complete, accurate and truthful for the proper processing of the Order, including your delivery address and contact information.

2.3 If you wish to delete your Sicpama account, where applicable, please complete the following steps before you do so:

(i) The Member may terminate the contract of use at any time by notifying the Company of his/her intention to terminate.

(ii) The contract of use shall be terminated when the member's intention to terminate reaches the company.

(iii)member who has been terminated pursuant to this paragraph may re-register as a member in accordance with the membership registration procedure and related provisions set forth in these Terms and Conditions.


2.4 After completing the steps in Clause 2.3 above (as the case may be), to delete your Sicpama account, please proceed with the following steps:

(i) Open the side bar menu

(ii) Tap “Profile”

(iii) Tap “Delete my account”

If you are not able to delete your Sicpama account in clause 2.3 , you may reach out to us under your profile at the Help Center via 1) the Platform or 2) this email:

2.5 In operating the service, the company may display various information or advertisements on the service screen or provide it to the member by e-mail, text message, or various electronic transmission media (text message, e-mail, app push notification, etc.). If you wish to unsubscribe to our information or advertisements received via:

2.5.1 email

i) please click on the “unsubscribe” button at the end of our email; or ii) under the Platform, select “Settings” under your profile, turn off “Received offers by email”.

2.5.2 SMS or text messages

i) please click on the “unsubscribe” button at the end of the SMS/text messages.

2.6 We may terminate the contract of use if we reasonably believe that (In this case, the Company notifies the Member of the intention to terminate by e-mail, telephone, fax, and other methods. However, the company may give the member an opportunity to express his or her opinion on the reason for termination in advance.):

2.6.1 When you infringe on the rights, honor, credit, or other legitimate interests of the company, other members, or others, or violates the laws of the Singapore or public order

2.6.2 If you acts in violation of these Terms and Conditions or the reason for termination stipulated in these Terms and Conditions occurs.

2.6.3 The contract of use is terminated when the company notifies the member of the intention to terminate. In this case, the company will notify the intention to terminate by sending it to the e-mail registered by the member or posting it on the company bulletin board.

2.6.4 Damages incurred in connection with the termination of the contract of use shall be borne by the party responsible for the termination of the contract of use.


3 Restrictions

3.1 Activities Prohibited on the Platform

The following is a non-exhaustive list of the types of conduct that are illegal or prohibited on the Platform. Sicpama reserves the right to investigate and take appropriate legal action against anyone who, in sicpama´s sole discretion, engages in any of the prohibited activities. Prohibited activities include, but are not limited to the following:

3.1.1 Members shall comply with the relevant laws and regulations, the provisions of these Terms and Conditions, and the information of use, and shall not engage in other acts that interfere with the Company's business.

3.2 Members shall not engage in any of the following acts in connection with the use of the service.

3.2.1 Registration of false contents when applying for or changing the service

3.2.2 Unauthorized changes to information posted on the Site

3.2.3 Transmission or posting of information (computer programs, etc.) other than those set forth by the Company

3.2.4 Infringement of intellectual property rights such as copyrights of the Company or other third parties

3.2.5 Acts that damage the reputation of the Company or other third parties or interfere with their business;

3.2.6 Disclosure or posting of obscene or violent messages, images, voices, or other information contrary to public morals on the Site

3.2.7 Other acts that violate related laws or regulations set by the company

3.2.8 Reproduction, disassembly, imitation, or otherwise modification of the Service through reverse engineering, decompilation, disassemblage, or any other processing

3.2.9 Using the Service in a way different from normal usage, such as using an automatic access program, etc., to cause a load on the Company's server and interfere with the Company's normal service.

3.2 Sicpama reserves the right but is not obligated to do any or all of the following:

3.2.1 If a member violates the obligations of these Terms and Conditions or interferes with the normal operation of the service, the company may gradually restrict the use of the service by warning, suspension, permanent suspension, etc.

3.2.1 investigate an allegation that any content posted on the Platform does not conform to these Terms and determine in its sole discretion to remove or request the removal of the content. All rights and responsibilities for posts made by members belong to the member who posted them and if the company pays damages to a third party due to illegal postings (whether mediation, settlement, or judgment), the member who has the reasons attributable thereto shall pay the company the equivalent of the same amount as soon as the company pays compensation to the third party.;

3.2.2 remove content which is abusive, illegal, or disruptive, or that otherwise fails to conform with these Terms;

3.2.3 In case of infringement of intellectual property rights such as copyright of the company or copyright of a third party

3.2.4 When posting pornographic materials or linking to pornographic sites

3.2.5 In the event of posting commercial advertisements or promotional contents that have not been approved in advance by the Company

3.2.6 If the content is defamatory or defamatory to other members or a third party

3.2.7 If content violates relevant laws such as the Information and Communications Network Act and the Copyright Act, right holder may request the suspension or deletion of the post to the following email address in accordance with the procedures prescribed by the relevant laws and regulations, and the company shall take action in accordance with the relevant laws and regulations.

3.2.8 Even if there is no request from the right holder pursuant to 3.2.7, Sicpama may take temporary measures against the post in accordance with the relevant laws and regulations if there is a reason for recognition of infringement of rights or if it violates other company policies and related laws.


4 Intellectual Property

You shall not use the information obtained by using the postings and services created by the Company for commercial purposes or make it available to a third party by reproduction, transmission, publication, distribution, broadcasting, or other methods without the prior consent of the Company.

5 Orders

5.1 When you place an Order with Sicpama, Sicpama will confirm your Order by showing “order sent” screen. We will also send you a confirmation email containing the Order receipt.

5.2 Special Instructions – Sicpama and the vendor reasonably endeavour to comply with your special instructions for an Order. However, in some cases where this is not feasible, possible or commercially reasonable, Sicpama and company reserve the right to proceed to prepare the Order in accordance with standard operating procedures. Neither Sicpama nor the company shall be responsible to replace or refund an Order which does not conform to special instructions provided by you.

5.3 Allergens – Sicpama is not obligated to provide ingredient information or allergen information on the Platform. Further, Sicpama does not guarantee that the Goods sold by Vendors are free of allergens, unless otherwise required by applicable laws. If you have allergies, allergic reactions or dietary restrictions and requirements, please note it on comment section before placing an Order on our Platform.

5.4 Placing the Order

To complete an Order, please follow the onscreen instructions after clicking ‘Checkout’. You may be required to provide additional details for us to complete your Order. You are required to review and confirm that all the information you provide, including the amounts, delivery details, personal details, payment information, and voucher codes (if applicable) is true, accurate and complete before you click “PLACE ORDER”. An Order is successfully placed when you receive an email confirmation containing your Order receipt from us.

5.5 Cancelling an Order

Please access the Help Centre on the Platform if you wish to cancel your Order after it has been placed. You have the right to cancel your Order provided a Vendor has not yet accepted your Order.

5.6 Refunds

(i) Online Payment Orders

You have the right to a refund for exchange or refund due to defects in the product or provision of a different product from the one ordered, Sicpama will take necessary steps for the refund (including the refund of price differences arising from the product exchange) within 3 to 5 business days.

(ii) Orders with unavailable items

If the company is unable to provide the product you ordered due to unavoidable circumstances, the company will promptly notify you the reason and take necessary steps for the refund within 3 to 5 business days if the product price has already been received.

If you are entitled to a refund in accordance with the refund and cancellation policies set out in these Terms, you agree that:

a. Sicpama will refund the payment to the account used for the original payment. b. If you made a purchase via Sicpama but don't have a Sicpama account, we will still refund your payment to the account used for the original payment.

We may require you to provide additional information or supporting documents prior to processing any refund. We may, in our sole discretion, refuse to process any refund if you fail to provide such additional information or supporting documents.

If you have not received a refund, you may wish to check your bank account again or contact your credit card company or bank as it may take some time for your refund to be posted. If you have done all of this and you still have not received your refund, please contact customer support via one of the methods set out in Clause 1.3 above.

5.10 Sicpama reserves the right to cancel any Order and/or suspend, deactivate or terminate your Sicpama account in its sole discretion if it reasonably suspects or detects fraudulent behaviour or activity associated with your Sicpama account and/or with your Order.


6 Prices and Payments

6.1 A breakdown of the prices and additional charges (including but not limited to delivery, small order or service fees) are displayed before checkout. When you place an Order, you agree to all amounts, additional charges and the final ‘Total’ amount which is displayed to you.
6.2 You can choose to pay for an Order using any of the different payment methods offered on the Platform including:
6.3.1 Our payment partners: Visa, Mastercard, American Express, Google Pay, PayPal, Apple Pay;
6.3.2 Cash payment is not available
6.4 If you have existing credit in your Sicpama account or valid promotional or discount vouchers, you can use this pay for part or all of your Order as the case may be.
6.5 After an Order is successfully placed, you will receive an email confirmation from us with your Order receipt only if you request.
6.6 Payment Methods
Sicpama reserves the right to offer additional payment methods and/or remove existing payment methods at any time in its sole discretion. If you choose to pay using an online payment method, the payment shall be processed by our third party payment service provider(s). With your consent, your credit card / payment information will be stored with our third party payment service provider(s) for future Orders.

7 Representations, Warranties and Limitation of Liabilities

7.1 Representations and Warranties

You acknowledge and agree that the content on the Platform is provided on an “as is” and “as available” basis, and that your use of or reliance upon the Platform and any content, goods, products or services accessed or obtained thereby is at your sole risk and discretion.

All photos and images of the Goods are also for illustrative purposes only and may differ from the actual Goods.

While Sicpama makes reasonable efforts to ensure the provision of the Platform and the Services we offer, are available at all times, we do not warrant or represent that the Platform shall be provided in a manner which is secure, timely, uninterrupted, error-free, free of technical difficulties, defects or viruses. Please expect temporary interruptions of the Platform due to scheduled or regular system maintenance work, downtimes attributable to internet or electronic communications or events of force majeure.

7.2 Limitation of Liability

To the extent permitted by law, Sicpama (which shall include its employees, directors, agents, representatives, affiliates and parent company) exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Platform, our Services, and any website linked to our Platform and any content or material posted on it. Your exclusive remedy with respect to your use of the Platform is to discontinue your use of the Platform. The Sicpama entities, their agents, representatives, and service providers shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the Platform or for any other claim related in any way to your use of the Platform. These exclusions for indirect, special, consequential, and exemplary damages include, without limitation, damages for lost profits, lost data, loss of goodwill, work stoppage, computer failure, or malfunction, or any other commercial damages or losses, even if the Sicpama entities, their agents, representatives, and service providers have been advised of the possibility thereof and regardless of the legal or equitable theory upon which the claim is based. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, Sicpama, the Sicpama entities, its agents, representatives and service providers' liability shall be limited to the extent permitted by law.

7.3 Vendor’s representations

Sicpama shall neither be liable for actions or omissions of the Vendor nor you in regard to provision of the Goods and where Vendor applies to your Order. Sicpama does not assume any liability for the quantity, quality, condition or other representations of the Goods and/or services provided by Vendors or guarantee the accuracy or completeness of the information (including menu information, photographs and images of the Goods) displayed on the Vendor’s listing/offering on the Platform. Nothing in these Terms shall exclude Vendor’s liability for death or personal injury arising from Vendor’s gross negligence or willful misconduct.

10 Vendor Liability

Vendors are solely responsible for the preparation, condition and quality of Goods sold to you. Sicpama shall not be responsible or liable for any loss, damage, expense, cost or fees arising from your contractual relationship with the Company.

11 Personal Data (Personal Information) Protection

11.1 You agree and consent to Sicpama and any of its affiliate companies collecting, using, processing and disclosing your Personal Data in accordance with these Terms and as further described in our Privacy Policy. Our privacy policy is shown in the initial screen of the service. Our Privacy Policy is incorporated by reference herein and accessible here ( ) or via the links on our Platform.

11.2 Sicpama's personal information processing policy does not apply to linked sites other than the Sicpama’s official website. With regard to the processing of personal information by linked sites and third parties providing purchased products or services, you are responsible for checking the privacy policies of such sites and third parties, and the we are not responsible for this.

12 Indemnity

You agree to indemnify, defend, hold harmless Sicpama and its directors, officers, employees, representatives, agents, and affiliates, from any and all third party actions, claims, liabilities, damages, penalties and/or costs (including but not limited to, legal fees) arising from or related to your:

12.1 use of the Platform;

12.2 use of the Services; or

12.3 breach of these Terms.

13 Termination

Sicpama has the right to terminate, suspend or delete your account and your access to or use of the Platform, including any service we provide to you in respect of an Order, for any reason, including, without limitation, if Sicpama in its sole discretion:

considers your use to be unacceptable; If a member does not log in continuously for more than 3 months. suspects or discovers you to have been involved in any activity or conduct that is in breach of any of the Terms. Sicpama may, but shall be under no obligation to, provide you a warning prior to termination of your use of the Platform.

14 Amendments

Sicpama may amend these Terms at any time in its sole discretion, and the amended Terms shall be effective immediately upon posting, subject to applicable laws. It is your responsibility to check the Terms regularly. If you do not agree with the amended Terms, whether in whole or in part, you must stop using the Platform immediately.

15 Severability

If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any provision in these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
